REGULATIONS FOR SHORT-TERM RENTING OF
CYRHLA APARTMENTS
EFFECTIVE AS OF 20.12.2024
General provisions
1.1. These Terms and Conditions define the conditions for booking and the short-term rental service of premises available from CYRHLA APARTAMENTY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Rzeszów at Al. Tadeusza Rejtana 20A, KRS: 0001088976, NIP: 8133911472, biuro@cyrhla-apartamenty.pl, www.cyrhla-apartamenty.pl,. As part of the short-term apartment rental service, CYRHLA APARTAMENTY undertakes to make the Apartment available to the Client, and the Client undertakes to pay the fee and comply with the rules set out in these Regulations.
1.2. Before making a reservation, the Client is obliged to read the Regulations. Making a reservation is tantamount to accepting its content.
1.3. CYRHLA APARTAMENTY declares that it has the legal title to the Apartment, which is the subject of the contract concluded with the Client, and is entitled to provide the service of temporary provision of the Apartment for tourist or leisure purposes.
1.4. CYRHLA APARTAMENTY informs its customers that, pursuant to Article 38(12) of the Act of May 30, 2014, i.e. of December 7, 2023 (Journal of Laws of 2023, item 2759) on consumer rights, in the case of a contract for the provision of accommodation services other than for residential purposes, the consumer shall not have the right to withdraw from a contract concluded at a distance or off-premises, which the Client hereby acknowledges.
Definitions
2.1. Apartment – a residential unit offered by CYRHLA APARTAMENTY, described in detail on the website www.cyrhla-apartamenty.pl or other intermediary portals, which is the subject of the booking;
2.2. CYRHLA APARTAMENTY understood as CYRHLA APARTAMENTY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Rzeszów at Al. Tadeusza Rejtana 20A, KRS: 0001088976, NIP: 8133911472, biuro@cyrhla-apartamenty.pl, www.cyrhla-apartamenty.pl,.
2.3. Client – a guest, a natural person (over 18 years of age) or a legal person who is a party to a short-term apartment rental agreement or who expresses their willingness to use the services of CYRHLA APARTAMENTY by booking a selected apartment;
2.4. Regulations – these Short-Term Rental Regulations;
2.5. Resident – a person appointed by CYRHLA APARTAMENTY who is authorized to hand over and collect the Apartment from the Client, as well as to perform other activities specified in these Regulations;
2.6. Website – the website www.cyrhla-apartamenty.pl or another website through which it is possible to make a Booking;
2.7. Reservation – an act of choosing an Apartment and the date of stay in the Apartment by the Client and possibly other conditions of such stay, made via the Website or by phone, whereby a contract is concluded between CYRHLA APARTAMENTY and the Client for the rental of the Premises in accordance with the offer and the rules set out in the Regulations.
Booking
3.1. Making a reservation is tantamount to accepting the content of the Regulations.
3.2. The Apartment can be booked in the following ways:
Using the booking form provided by CYRHLA APARTAMENTY via the website www.cyrhla-apartamenty.pl;
Via the hotline at: + 48 727 941 092 available only from Monday to Friday from 9:00 a.m. to 5:00 p.m.;
By e-mail: biuro@cyrhla-apartamenty.pl;
Through the CYRHLA APARTAMENTY intermediary portal.
3.3. During the booking process, the Client is required to provide the following information:
Period of stay (check-in and check-out dates);
Selected Apartment;
Contact details (first name, last name, telephone number, address, e-mail address);
The number of people in the Apartment, with the proviso that it may not exceed the permitted number of people indicated in the offer;
Planned time of arrival;
Additional services;
3.4. CYRHLA APARTAMENTY confirms the booking by sending an email to the address provided by the customer during the booking process, containing information about the confirmation of the booking, a summary of the offer and the total price of the service.
3.5. Children under 4 years of age who sleep with their guardian or in their own private cot, for which no additional bedding is required, may stay free of charge. Each guardian may have one child under 4 years of age stay free of charge. When making a reservation, the total number of people must be stated, including the age of the children and taking into account children whose stay is considered free of charge (the information should be added in the COMMENTS tab). The maximum number of people in a room, including children, must not exceed the maximum number of people allowed in the Apartment.
Reservation fee
4.1. A Customer making a Reservation via the Website is obliged to pay the total price of the service indicated in the Reservation summary, following the instructions provided in the reservation panel.
4.2. In the case of a telephone Booking, in order to confirm it, the Client is obliged to immediately pay the booking fee by bank transfer to the account indicated in the booking confirmation (in the amount of min. 30% of the service price). Failure to make the payment by 3 p.m. on the following day entitles CYRHLA APARTAMENTY to cancel the reservation. The remaining amount of the service fee must be paid no later than 7 days before the agreed date of the beginning of the stay in the Apartment. However, if there are less than 7 days left until the date of your reservation when you make the reservation by phone, you must pay the total amount of the reservation at the time of booking by bank transfer. The transfer must include the name of the apartment, the date of your stay and your reservation number in the payment description. Changing/canceling a reservation
5.1. Changing a reservation is only possible if the apartment is not already booked on another date selected by the Client. If the price of the service on the new date is higher than before, the Client is obliged to cover the difference in the price of the service. If the price of the service on the new date is lower than the previous one, CYRHLA APARTAMENTY will refund the difference in the price of the service to the Customer within 14 days. It is possible to change the Booking up to 7 days before the start of the stay in the Apartment.
5.2. The Customer may cancel the Booking up to 7 days before the planned day of arrival at the Apartment. In such a case, the booking fee paid by the Customer minus the fee charged by the payment operator (approx. 1.5% of the payment) shall be refunded within 7 working days to the bank account number provided. If the booking is canceled after the specified deadline, the booking fee will not be refunded.
5.3. In addition to the situation indicated in point 5.2 above, the Booking may be canceled by the Customer if, for reasons beyond the Customer's control, it is not possible to provide the Customer with the Apartment in a condition consistent with its intended use within the time limit resulting from the Booking - such as an Apartment failure, a booking system error or the withdrawal of the Apartment from the offer. In such a case, the Client will be offered an Apartment of a comparable standard or the option to cancel the Booking free of charge.
5.4. In the event of unforeseeable circumstances in the Apartment booked by the Client, the consequences of which cannot be remedied, CYRHLA APARTAMENTY will offer the Client a replacement Apartment of a similar standard. In such a case, the Client has the right to cancel the Booking with the obligation to refund all payments made by the Client to the indicated bank account.
5.5. In the event that the Reservation is paid for in full or in part by vouchers or gift vouchers, the voucher or gift voucher value cannot be refunded if the Reservation is canceled by the Client or for reasons attributable to the Client.
Check-in and check-out
6.1. The hotel day starts at 3:00 p.m. on the day of arrival according to the Booking (check-in) and ends at 10:00 a.m. on the day of departure according to the Booking (check-out).
6.2. Check-in is self-service based on the instructions sent on the day of arrival to the telephone number provided during the booking process.
6.3. On the day of check-out, the Client is obliged to leave the keys to the Apartment in a suitable place, in accordance with the instructions sent on the day of check-in. The same rule applies to remote controls and parking cards (if provided to guests). Failure to comply with this rule may result in the Customer being charged up to the amount incurred by CYRHLA APARTAMENTY.
6.4. CYRHLA APARTAMENTY reserves the right to charge a deposit of PLN 500 as security for the stay. The deposit will be refunded in full on the day of departure, provided that no damage has been caused to the apartment. The amount of the deposit may vary depending on the nature of the stay (a higher amount may be charged for special events and stays during public holidays) and the number of people. Deductions of CYRHLA APARTAMENTY's claims from the deposit do not exclude the right to claim for damages and loss of potential income, the value of which exceeds the deposit collected.
6.5. CYRHLA APARTAMENTY reserves the right to refuse to hand over the Apartment and to cancel the Booking for persons under the influence of alcohol or narcotics, behaving aggressively and posing a direct threat to other people and property. CYRHLA APARTAMENTY may refuse to hand over the Apartment to Customers who have grossly violated the Regulations during their previous stay, including in the event of having unpaid payments.
6.6. Before checking out, CYRHLA APARTAMENTY reserves the right to check the technical condition of the Apartment. In the event that any damage is found to have been caused during the Client's stay, the Client shall be obliged to cover the repair costs in full, at the latest on the day of check-out.
6.7. Early departure for reasons not attributable to CYRHLA APARTAMENTY shall not entitle the Client to claim reimbursement for any unused services.
Customer's obligations during the stay in the apartment
7.1. The Customer undertakes to use the Apartment exclusively for tourist or leisure purposes and may not sublet the apartment or allow any third party to use it free of charge.
7.2. Immediately after checking in, the Client should report any irregularities found in the Apartment, otherwise the Client may be charged with the costs of repairing the identified damage.
7.3. There is a quiet time in the Apartment from 10 p.m. to 6 a.m. In case of non-compliance with generally accepted norms of social conduct, disturbance of neighbors' peace, CYRHLA APARTAMENTY reserves the right to terminate the Booking immediately, without the obligation to reimburse the costs for the unused period of stay.
7.4. Organizing any kind of events in the Apartments is prohibited. In case of violation of the prohibition to organize events, the Landlord reserves the right to terminate the Booking immediately, without the obligation to reimburse the costs for the unused period of stay.
7.5. Smoking, stimulants and electronic cigarettes are strictly prohibited in the Apartment. In case of non-compliance with the ban, CYRHLA APARTAMENTY may charge an additional fee of 500 PLN, which does not limit CYRHLA APARTAMENTY's right to claim damages under general rules.
7.6. Customers are obliged to properly secure the Apartment, which is understood as carefully closing the entrance door and windows every time they leave it and carefully storing the keys without access to them by unauthorized persons. It is forbidden to take any items from the Apartment. Customers are obliged to take care of the rented Apartment, including: switching off unnecessary lighting, turning off the water, not removing information posted on the Apartment door.
7.7. The Client is obliged to maintain and return the Apartment in an intact condition, except for wear and tear resulting from normal use. On the day of departure, the Apartment's guests are obliged to throw away their garbage in the containers located outside the building.[2]
7.8. CYRHLA APARTAMENTY or another authorized person has the right to enter the Apartment to fix any malfunctions or in case of a justified suspicion that the Client violates the Terms and Conditions.
7.9. The Client is obliged to pay special attention to the proper handling of batteries, fittings and electrical devices. Due to fire safety regulations, the Client may not use any non-equipment devices powered by electricity, with the exception of: a computer, a shaver, a hair dryer, a phone charger.
7.10. CYRHLA APARTAMENTY is not responsible for items left in the apartment. Any return of found items is possible only at the expense of the Client.
7.11. The Client is responsible for the actions and omissions of all guests staying with them in the Apartment as if they were their own.
Additional services
8.1. The Client has the option of ordering additional services according to the following price list:
Stay of a pet - 300 PLN/day/pet, only in selected Apartments;
Linen and towel change service - price determined individually depending on the number of guests. The date and time of the service must be agreed at least one day in advance and confirmed by CYRHLA APARTAMENTY;
Apartment cleaning service - 200 PLN, one-time service;
8.2. Additional services are provided after confirmation of payment to the CYRHLA APARTAMENTY account.
Pets
9.1. Pets are only allowed in selected Apartments. The Apartment staff has the right to refuse access to the Apartment to Customers who have brought a pet without prior arrangement.
9.2. A vaccination certificate is required. All pets must have their own bed/kennel, etc. Pets are not allowed on sofas, armchairs, etc.
9.3. An additional fee for the stay of animals is charged according to the price list of Additional Services and payable before arrival to the account of CYRHLA APARTAMENTY. In the case of more than one animal, CYRHLA APARTAMENTY reserves the right to charge an additional deposit of PLN 1000.
9.4. The owner is obliged to clean up after their animal.
9.5. The customer bears full responsibility for the animal's stay and any damage caused by it, including in particular cleaning carpets, armchairs, sofas from hair or removing unpleasant odors.
9.6. If, on the day of check-out, the condition of the Apartment prevents the stay of subsequent persons, a financial penalty equal to twice the price per night of the Apartment will be imposed on the Client.
Liability
10.1. CYRHLA APARTAMENTY is not liable for any inconveniences arising during the stay related to:
Construction or finishing works carried out on the premises where the Apartment is located and around it;
Interruption of utility services for reasons beyond the control of CYRHLA APARTAMENTY;
Noise from neighboring properties.
10.2. CYRHLA APARTAMENTY is not liable for any loss of or damage to a vehicle left by the Client in the garage belonging to the Apartment or in the outdoor parking spaces.
10.3. The client is responsible for any damage caused by his/her actions resulting from the use of paid or unpaid attractions located on the premises where the client rents the apartment.
10.4. The client is obliged to immediately report any damage caused by him/her during the stay and to pay for it immediately. The client is also fully responsible for damage caused by persons staying in the Apartment with his consent or knowledge. If the damage prevents further rental, the Client shall additionally bear financial responsibility for each day excluded from the rental, in the amount of twice the current price for the Apartment.
10.5. In case the apartment is contaminated with vomit, the Client is obliged, upon CYRHLA APARTAMENTY's request, to cover the costs of cleaning carpets and other contaminated materials - in the amount of 1500 PLN.
10.6. Smoking cigarettes, other tobacco products, stimulants in the Apartments and in the stairwells and garage, as well as the use of candles is prohibited. Violation of the ban entitles CYRHLA APARTAMENTY to impose a contractual penalty of PLN 1000.
10.7. In the event of failure to return the Apartment after the end of the booking, the Client shall be obliged to pay twice the current price for the given Apartment, specified on the website www.cyrhla-apartamenty.pl, for each day after the end of the booking.
10.8. Upon check-out, the Client is obliged to return all provided keys, entry cards and remote controls. In case of failure to do so, the Client shall be charged PLN 500 (keys, entry card) and PLN 500 (remote control), respectively.
10.9. The number of people staying in the apartment cannot exceed the number stated during the booking. If the number of people is exceeded, the Client will be charged an additional fee of 300 PLN for each additional person per night.
10.10. In the event that the damage exceeds the value of the penalty or additional fee stipulated in these Terms and Conditions, CYRHLA APARTAMENTY shall be entitled to claim damages in accordance with general principles.
10.11. In the event of an unjustified request for a CYRHLA APARTAMENTY employee to visit the rented apartment, an additional fee of 300 PLN will be charged, which will be collected by an authorized CYRHLA APARTAMENTY employee.
Complaints
11.1. In the event of any irregularities, the Tenant has the right to file a complaint within 14 days of their occurrence. Complaints should be sent in writing to the address of CYRHLA APARTAMENTY or by e-mail to biuro@cyrhla-apartamenty.pl.
11.2. Complaints shall be considered within 30 working days of their receipt. The Client shall be immediately notified of the consideration of the complaint by registered letter or by e-mail to the appropriate address indicated in the complaint.
11.3. For the pursuit of claims in court, the court competent for the registered office of CYRHLA APARTAMENTY is the District Court in Rzeszów, and the defendant should be the company CYRHLA APARTAMENTY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Rzeszów at Al. Tadeusza Rejtana 20A, KRS: 0001088976, NIP: 8133911472. The consumer also has the right to seek assistance from the Municipal or District Consumer Ombudsman.

Privacy policy
13.1. The administrator of personal data is CYRHLA APARTAMENTY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Rzeszów at Al. Tadeusza Rejtana 20A, KRS: 0001088976, NIP: 81339114728.
13.2. Personal data is processed for the purpose of fulfilling the Booking and the Terms and Conditions. Providing data is voluntary, but necessary to use the services of CYRHLA APARTAMENTY. Personal data will be processed until the statute of limitations expires for claims arising from the booking or service performance, and in the case of data collected on the basis of consent, until it is revoked.
13.3. The basis for the processing of personal data is:
Art. 6(1)(b) of the GDPR - the necessity of their processing for the purpose of the performance and execution of the contract;
Art. 6(1)(f) of the GDPR - the legitimate interest of the controller in handling correspondence and marketing activities.
13.4. Customers have the right to access their data and the right to request that their data be corrected, deleted or that its processing be restricted. The customer has the right to object to the processing of personal data.
13.5. To the extent that the processing of personal data is based on consent, the customer has the right to withdraw their consent. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. Data may be subject to profiling within the scope of the consent given.
13.6. Personal data may be transferred to companies providing accounting and legal services, as well as entities cooperating in the service of apartments.
13.7. In all matters regarding the processing of personal data and the exercise of rights related to data processing, you can contact us by post at the address of the Controller's registered office, indicated in point 12.1., or by e-mail at: biuro@cyrhla-apartamenty.pl. The customer has the right to lodge a complaint with the supervisory body dealing with the protection of personal data (President of the Office for Personal Data Protection).
